1. Introduction and Acceptance of Terms
1.1. Company & Brand: These Terms of Use (the "Terms") govern your use of the GANA MART service, operated by Gana Trading Company. GANA MART is a B2C platform for the sale and delivery of grocery products (the "Platform").
1.2. Agreement: By accessing or using the Platform, you agree to be bound by these Terms and the GANA MART Privacy Policy. If you do not agree to these Terms, you must not use the Platform.
1.3. Eligibility: You must be 18 years of age or older to use the Platform and purchase products. Minors may use the Platform only under the supervision of a parent or legal guardian.
1.4. Updates: Gana Trading Company reserves the right to change, modify, or update these Terms at any time. Your continued use of the Platform signifies your acceptance of the revised Terms.
2. User Account and Registration
2.1. Account Creation: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
2.2. Accurate Information: You agree to provide and maintain current, complete, and accurate registration information, including your name, delivery address, mobile number, and email address.
2.3. Account Security: You must immediately notify GANA MART of any unauthorized use of your account.
2.4. Account Deletion: You may terminate your account at any time by utilizing the "Delete My Account" option available under the My Profile/Settings section on the Platform, or by submitting a formal request to our Grievance Officer. Account deletion will be processed as per our Privacy Policy, upholding your Right to Erasure.
3. Orders, Pricing, and Payment
3.1. Contract of Sale: The contract of sale for the products is between you and Gana Trading Company.
3.2. Product Availability: All products listed are subject to availability. GANA MART reserves the right to cancel any order if the product is unavailable or due to reasons including, but not limited to, incorrect pricing.
3.3. Pricing: The final price is the price displayed on the checkout page at the time of order placement. Prices are subject to change without notice.
3.4. Order Modification/Cancellation (User): You can cancel or modify an order within [Specify a time window, e.g., 1 hour] before the scheduled delivery slot. After this period, cancellation may not be possible, or a cancellation fee may apply.
3.5. Order Cancellation (GANA MART): GANA MART reserves the right to cancel an order. We will not impose cancellation charges on consumers unless similar charges are borne by GANA MART for unilateral cancellation, in compliance with e-commerce rules.
3.6. Payment: You agree to pay for all products and services purchased. Accepted payment methods will be listed on the Platform.
4. Delivery Policy
4.1. Delivery Area: Services are limited to specified geographic areas.
4.2. Delivery Slots: Orders will be delivered within the confirmed time slot. Delivery times are estimates, and GANA MART shall not be liable for any delay due to unforeseen circumstances.
4.3. Receipt of Goods: You or your authorized representative must be present to receive the delivery.
4.4. Failed Delivery: If a delivery fails due to your fault (e.g., incorrect address, unavailability), GANA MART may charge a re-delivery fee or cancel the order.
5. Returns, Refunds, and Replacements
5.1. Return Policy: Products can be returned at the time of delivery if found damaged, expired, or of poor quality. Due to the perishable nature of groceries, specific products may have restrictions on returns after acceptance.
5.2. Quality Assurance: If a product is received in an unusable condition, you must report it within 2 hours of delivery with photographic evidence.
5.3. Refunds: Refunds for cancelled or returned orders will be processed as per GANA MART's separate Refund Policy (to be created), detailing the timeline and method.
6. User Conduct and Obligations
6.1. Lawful Use: You agree to use the Platform only for lawful purposes and not to violate any applicable Indian laws or regulations.
6.2. Prohibited Activities: You must not engage in any activity that interferes with or disrupts the Platform (e.g., uploading viruses, attempting unauthorized access).
6.3. Reviews and Comments: Any content you post must not be illegal, obscene, abusive, defamatory, or infringing of intellectual property rights. GANA MART reserves the right to remove or edit such content.
7. Intellectual Property Rights (IPR)
7.1. Ownership: Gana Trading Company owns all content, trademarks, logos, and software on the GANA MART Platform, protected by Indian copyright and trademark laws.
7.2. Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial use only.
8. Indemnity and Limitation of Liability
8.1. Indemnity: You agree to indemnify and hold harmless Gana Trading Company, its directors, officers, and employees from any claims, liabilities, damages, and costs arising from your use of the Platform or your breach of these Terms.
8.2. Limitation of Liability: Gana Trading Company shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the Platform.
9. Governing Law and Dispute Resolution
9.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of India.
9.2. Jurisdiction: Any disputes or claims arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts located in Visakhapatnam, Andhra Pradesh.
9.3. Grievance Officer: Details of the designated Grievance Officer, as required by the Consumer Protection (E-Commerce) Rules, 2020:

10. Miscellaneous
10.1. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in force.
10.2. Electronic Communications: By using the Platform, you consent to receive communications from Gana Trading Company electronically.
